Family Law Practice Group
Introduction
Wyse Kadish LLP provides a full range of family law services, including divorces, modifications and enforcement of existing judgments, prenuptial agreements, and domestic partnership agreements. Josh Kadish and David Bean provide most services, with support from other attorneys, paralegals and legal assistants in the firm. Wyse Kadish LLP offers a wide range of traditional and nontraditional approaches to resolving cases.
Litigation Services
Wyse Kadish LLP offers traditional litigation services as a means of resolving domestic disputes. Most litigated cases follow a standard series of steps. After a case is filed, there may be a preliminary hearing to establish temporary support and parenting time until the case is finally resolved. Alternatively, the parties may agree about these issues, in which case an order may be entered with the court regarding these matters. Next, the parties produce financial records,so that there is a complete understanding of the family's economic situation. Experts may be brought in, such as accountants, appraisers, actuaries, or financial planners, to help the attorneys and the parties understand financial issues. There may be experts such as psychologists and vocational therapists to help with issues involving children and work. Typically, each party's deposition is taken, so that each attorney can develop an understanding of how the opposing party views the case and how he or she will testify at trial. At this stage, or perhaps earlier in the process, we attempt to settle some or all issues by engaging in negotiation. We may be assisted by a neutral, third-party mediator, or the negotiation may take place between attorneys, or between attorneys and clients. If the case cannot be resolved, it is finally tried before a judge.
We have many years of experience in taking clients through this litigation process. For a more detailed description of how we will handle your case, please contact us for a consultation.
Consultation and Collaborative Services
Many of our clients wish to avoid litigation and desire more amicable, cooperative approaches to family law matters. Wyse Kadish LLP specializes in such less traditional, non-litigation methods.
First, we offer consultation services, largely for clients who wish to negotiate their own cases, with or without the use of a mediator. We offer support and advice to clients regarding how to successfully negotiate directly with their spouses, or using a mediator. Because we are not offering full litigation services in this context, we enter into limited consulting arrangements with clients on a regular basis. This is an excellent way to keep attorney fees down, but still enjoy the support of an experienced attorney.
Second, Josh Kadish offers mediation services for couples who wish to work with a mediator. For complete information on Josh's services, click on this link to Josh's mediation website.
Third, Wyse Kadish LLP offers collaborative law services. Collaborative law is a relatively new legal approach in which both attorneys and clients sign a contract agreeing that the attorneys will not litigate the case. Thus, all of the attorneys' efforts are focused on settling the case, because the only way they can succeed is to settle; they are not allowed to go to court. If the case is not resolved, the attorneys must resign and the clients must hire new attorneys to litigate the matter.
